This is a classic statement of the implications of an objective theory of contract that Holmes to some extent invented even though purporting to restate existing common law.  In a famous series of lectures in 1970, published as The Death of Contract, Professor Grant Gilmore explores the pivotal role of Justice Holmes in the development of classical contract theory, including the substitution of an objectivist for a subjectivist theory of contract.
