After his purchase, suppose that Zeidenberg had thrown the still shrink wrapped product onto his bookshelf where it gathered dust for three months.  Could he still return it for a refund then after reading the license and deciding not to use the product?  Could he still return it for a refund then without breaking the shrink wrap?  What if it had gathered dust for three years?
