The contract in question in fact expressly provided that the owner need only pay the contractor upon issuance of a certificate by the supervising architect, and the architect refused to issue a certificate because the contractor refused to replace the non-Reading pipe.  What more in the way of an express condition would have satisfied Cardozo?  Draft such a condition.
