THE PROGRAM

This distinguished panel will discuss the question Do Recent Changes to U.S. Patent Law and Practice Weaken or Strengthen the Patent System? in two parts, with reference to the following actual and proposed changes in the context of both US innovation and our international competitive position.

I. Patent Prosecution and Patent Quality issues: Nonobviousness,  Patentable subject matter,Continuation Limits, 5/25 Rule, First to File, Mandatory Publication, Post Grant Opposition
II. Licensing and Litigation issues: Declaratory Judgments. Injunctions, Damages Apportionment, Willfulness, Venue, Interlocutory Appeals, Specialized Courts, Elimination of Best Mode
