Death Penalty College Participant Memo

1) Schedule

A tentative schedule is posted on the website (www.scu.edu/law/dpc). This provides you with a general idea of the subjects that will be covered in workshops and lectures. As you can see, the program consists of three components: lectures, workshops, and demonstrations. The full schedule will be provided to you when you arrive. The small size of the program allows for questions and comments by participants during or following most lectures and demonstrations.

 

A more specific program will be posted when we receive final confirmation on the availability and schedules of the faculty.>

2) Workshops

The small group workshops are the heart of the program. During this time each participant performs an exercise using the facts from his or her own case. You must use the facts from a pending death penalty case. Each workshop provides several hours allowing you to perform, to receive feedback, and to engage in some discussion about areas of concern in your case.

 

Each group includes eight participating lawyers and usually two members of the faculty. One of the two faculty members is often an investigator, mitigation specialist, mental health professional or another member of a capital team. The participants in the group also provide comments and critiques to each other. The participants stay in the same group all week which allows a relationship of trust and support to be established. It also allows each of you to become familiar with the facts of the cases in your group and will enhance your ability to provide feedback.

 

If you do NOT intend to prepare and participate in the workshops, please consider a different program and allow someone else to attend this program.

 

The members of the faculty will rotate to the different groups. This allows you to see and hear different styles, approaches and perspectives that you can assess in the context of your own case.

3) Real case method

You must work from the facts of a pending death penalty case. It is important that you use this program to work through difficult aspects of the case with feedback from the group.

 

If you have not filled out the case questionnaire for registration, please do so immediately. Feel free to delete or change your client's name if you feel that is necessary. All participants and faculty sign a Confidentiality Oath establishing the privileged nature of the communications during the program.

4) Materials

Each participant receives a notebook of materials related to capital litigation and the sessions at the college. Other materials will be copied on a CD Rom that will be distributed. This notebook and CD-Rom will be provided to you when you arrive on the first day of class. This includes more lengthy material including law review articles on mitigation, motions, outlines, transcripts and other written materials helpful to the preparation of a penalty phase.

 

Lawyers who practice in California are strongly urged to purchase the CACJ/CPDA death penalty manual (available for purchase online at www.cacj.org). This comprehensive five-volume manual is by far the single greatest resource available for the preparation and trial of your upcoming capital case. Persons who practice out of state may wish to review the manual while at the college and evaluate whether it would be helpful in your practice as well. Although it focuses on California law, so much of the litigation is now "federalized" that it may be easily adapted to your own state or jurisdiction. This manual includes a discussion and analysis of all the basic issues raised in death penalty cases as well as a separate motions manual that provides you with sample motions on a large variety of topics.

5) Accommodations

The program tuition includes a single dorm room for all participants. The dorms are small suites. Each suite has four single bedrooms, 2 bathrooms and a small sitting area. They are even air conditioned (which I don’t even have at home!). The conditions and amenities are relatively basic. The dorms provide linens, blankets and towels. However, I recommend you bring a larger towel with you as well as your own toiletries.

 

Each room has an internet outlet for a computer. The dorms are NOT wireless, but the rooms are equipped for wired access to the internet if your computer is equipped with an Ethernet card (please bring a CAT5 or 6 internet cable). You will also have access to the law library and may access wired internet there as well. We are checking into whether the temporary passwords provided to access the wired internet will work where the campus is wireless as well and should know on the first day of the class.

 

SCU has had some problems with the internet in the dorms, if this is the case in your dorm room, please let the service desk know and they will try to fix it. There are other areas to access the internet, please ask the service desk or one of us.

 

Dorm rooms are provided from Saturday night through Wednesday night. If you need to arrive on Friday night or stay over on Thursday night, let us know by June 27th so that we may book the space. There will be an additional fee of $50 per night.

 

Most of your meals will be provided during the week beginning with dinner on Saturday night and ending with breakfast on Thursday. Breakfast will be in the university cafeteria. We will all have lunch together on campus. Dinner each night EXCEPT Tuesday will be provided at one of the campus facilities. Dinner on Tuesday night is on your own.

 

If you are not staying at the dorm, the meals are available to you with the group.

There is a swimming pool and gym facilities that you may use during your stay. If you wish to use the fitness facilities, please fill out and sign and mail the liability form prior to the beginning of the college. The law library is open and air conditioned for anyone who wishes.

6) Dress

The "dress" for the program is casual. The weather is likely to be very hot, but the classrooms are generally cold (air conditioned) so bring sweatshirts. Also, the evenings are always cool so bring a sweater to wear in the evening.

7) Messages

Most of you have cell phones so do not need a central place to receive a message. However, in case a contact number is needed, my office number is 408-554-4724. I will check messages several times during the day and alert you if something comes up. I can also get a fax to you if it is sent with my name on it to 408-554-4426. Persons can also send e-mail to my account at ekreitzberg@scu.edu

 

Finally, the University Public Safety Office numbers are 408-554-4441 (for non-emergencies) and 408-554-4444 (for emergencies). They will have a log of who is staying in every room and can contact you during the night if there is an emergency.

8) Transportation

San Jose International Airport is a short 10 minute ride from the campus. There is a #10 bus that is free and runs from the airport to a stop on campus. Directions from SJI to SCU (Click here to link to Mapquest directions)

Oakland International Airport is about a one hour drive from the school. It is more difficult to get from this airport to campus via public transportation, so keep that in mind. 9) When you arrive on campus and check-in

If you are driving, enter the campus at Accolti Way off of El Camino Real (see map at in lower right hand corner http://scu.edu/map/). The other side of Accolti Way (across El Camino Real) the street name is Campbell. Casa Italiana is building 602 and Sobrato Hall is next to it.

 

If you are arriving on Friday before 5pm, please check in at Casa Italiana service desk. After 5:00pm, there will be someone connected to the Death Penalty College with keys. More details to come.

 

f you arriving on Saturday, check-in will be from 10:00am-12:00pm at the Casa Italiana service desk.

 

We will check-in at the Casa Italiana Lobby and will then be staying in Sobrato Suites. Please check the campus map for their location. Check-in will be available Saturday morning beginning at 10:00am. You can go directly to the dorm where you will be issued a key.

 

You should come to Bannan 127 for the first lecture on Saturday, August 5, 12:00 noon. Lunch is on your own on Saturday and there are a number of small restaurants within walking distance.

10) Meals

Your meals will be provided during the week beginning with dinner on Saturday night and ending with breakfast on Thursday morning. Dinner on Tuesday is on your own providing an opportunity to explore San Francisco or the surrounding area. Breakfast is set up buffet style in the lobby of the dorm and the other meals are at the cafeteria or set up in a outside courtyard. We have a Bar-B-Q and final party one of the last nights outside (musical instruments are encouraged!)

 

If you are not staying at the dorm, the meals are available to you with the group. Breakfast, however, must be taken at the dorm.
