Credit/No Credit. Class will meet at the Public Defender Office. Enrollment is by application only. Applications available in the Law Records Office and for download online. Students will be placed at the Santa Clara County Public Defender Office. Students will be given the opportunity to represent real clients and to work on their cases at arraignments, pre-trial conferences, the motion calendar and, if necessary, at trial. The first week, students will receive intensive training from our misdemeanor supervisor, J.J. Kapp and will learn all facets of misdemeanor practice from arrest through sentencing and probation. The second week, students begin supervised work in a courtroom and will be required to prepare the files before court with a senior attorney. This means the student must perfect discovery, direct investigation, write and argue motions, and assist clients in the settlement of their cases. Whether a student is permitted to conduct a trial depend on their experience, progress, and aptitude. If there is a trial, a senior member of the Public Defender Office would help them prepare the case and would accompany them, at counsel table, throughout the proceedings. The program requires a great deal of commitment by a student to be able to take advantage of the opportunity to work on real cases. The lessons learned in this clinic will be invaluable for any students who expect to practice in the criminal justice system. Students may not participate in this clinic while working in law enforcement or in the district attorneys office.

The class will cover the federal income tax treatment of non-U.S. persons, non-U.S. income of U.S. citizens and residents, and international transactions. We will also discuss international consensus and formal agreements on matters of tax law. We will study the jurisdictional bases for U.S. tax, the source of income and allocation of deductions, different rules applicable to business and non-business income, and the foreign tax credit. We will also consider the U.S. approach to taxing international transactions involving related and unrelated taxpayers, including the problem of transfer pricing and the concept of the controlled foreign corporation. The Food and Drug Administration (FDA) regulates products representing approximately 25 cents of every dollar spent by consumers in the U.S. Food, drugs, biological products,  medical devices, cosmetics and dietary supplements all fall within FDA's broad jurisdiction. This course provides an overview of the laws and regulations of the FDA that restrict the sale of unsafe, deceptive or unproven foods and drugs. The course will also examine the scientific, economic and ethical issues that impact FDA's decisions. Any lawyer employed by an FDA-regulated company in any capacity, or who seeks to represent an FDA-regulated manufacturer, including not just regulatory law but also contract negotiation or patent prosecution, should be acquainted with the regulatory milieu in which the company operates. Evaluation: Research Paper. Class participation will be considered in determining the final grade.

The law students serve not only as an instructor and a weekly positive role model for 20 youth over the 14-week period, but also as a site leader. As a site leader, the students are responsible for communications with Probation, FLY, each of the youth, and the other volunteer law students. Site leaders evaluate the course and provide weekly feedback to the teaching team. The course includes three 2.5-hour orientation sessions, three lunch seminars, and regular check-in meetings. The trainings and seminars provide law students with instruction about substantive legal issues and professional skills such as, Public Speaking, Client Communication, Interviewing, Client Case Management, Juvenile Justice Research, Individual Evaluation, and Factual Investigation.

Emphasis is placed on students learning to recognize, understand and anticipate the changing relationships between technology, competition, regulation and law. In this seminar the student explores and addresses regulatory laws and policies governing the deployment and provision of broadband technologies and networks (DSL, cable modem, broadband over power lines, broadband satellites) and services such as voice over internet protocol (VOIP) and internet protocol television (IPTV). Policies addressed will include: net neutrality, statewide franchising of IPTV, electronic redlining, distinctions between information and telecommunication services, CALEA, emergency services, universal service and the digital divide/digital inclusion. The class will address the technologies, laws, and policies on the state and federal levels. The seminar requirements include: one group project, one presentation and one paper on a topic agreed to by student and professor. Consistent attendance and class participation are required and will be graded as well.
