Complex litigation often involves the collection, production, management and analysis of massive amounts of electronic data. This course considers the legal and operational issues associated with such processes.  Prerequisite: 114 (Pleading and Civil Procedure). 

Topics include:  the past to the present – how discovery in complex cases has changed with the onslaught of e-information;  a review of the key cases relating to e-Discovery – from the Enron to Zubulake; the new e-Discovery Federal Rules of Civil Procedure; the companion state procedures; understanding what e-information is and how it is stored at/by most companies; creating the e-Discovery discovery plan and coordinating the e-Discovery collection and e-Discovery ethical considerations.

Course meets only the first three weeks of summer session (May 29 to June 16). However, if instructor's litigation schedule requires, some classes may be rescheduled to same Tu/Sat times during later weeks of summer session (July 21 is the last possible date).

Graded Section. First day of class is May 29. Students must submit an application after enrolling. Students will be introduced to civil litigation skills during scheduled class time. Students will then practice the skills in the course of representing clients from the low-income community. Under the supervision of an attorney, students typically appear at settlement conferences and hearings. Two practice areas are available this summer: Worker's Rights and Immigration. Limited enrollment. Students must attend a mandatory training class on Saturday, June 2nd, 8:45 a.m. - 4:00 p.m.

Note: Students interested in working in the immigration practice area with political asylum, VAWA (battered immigrant spouses and children), U Visa (victims of particularly serious crimes), and T Visa (victims of human trafficking) cases MUST also register for the 1-unit credit/no credit course on trauma and working with traumatized clients (Health Law #418B). This one-unit course will be offered at the Law Center. Students who are unable to register for this one-unit course will be assigned non-trauma immigration cases such as relative petitions, citizenship, and other types of deportation defense cases.

This class meets the Professional Skills Requirement.

These  important skills transfer to professional work in large firms, government agencies, as well as criminal law offices.
