WHAT IS THE U.S.A. PATRIOT ACT?On October 26, 2001, President Bush signed the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001. USA PATRIOT Act of 2001, Pub. L. No. 107-56 (Oct. 26, 2001) (USA PATRIOT Act). This Act was enacted in response to the events of September 11, 2001. The Act enhances the governments power to compel disclosure of records - including student records - and to employ electronic surveillance devices. Section 507 of the USA PATRIOT Act amends FERPA as follows : An institution may disclose education records related to an authorized investigation to the Attorney General (or appropriate designee) when the court has issued an ex parte order permitting the Attorney General (or designee) to collect, retain, disseminate, and use in connection with the investigation or prosecution. In light of those increased powers, concerns about terrorism, and the concentration of technology, research, and foreign nationals on campuses, colleges and universities may be subject to more law enforcement requests than had been the case before September 11th.
