IV. When to Write for Copyright Permission for material to be placed on Electronic Reserve System:

A sample letter to be used in requesting permission to use a copyrighted work is attached at the end of these guidelines. As noted above, the Library will obtain copyright permission if it is available through the CCC. If permission is not available through the CCC, an original copy of the work may have information about obtaining copyright permission, or one might look at http://www.utsystem.edu/ogc/intellectualproperty/permissn.htm for suggestions on sources to obtain permission to use copyright materials.

Permission must be obtained:

  1. When an article from a journal is needed by a professor for more than one term, or if the item is a standard assigned optional reading for an individual course taught in multiple sections by many instructors.
  2. When multiple articles from one journal issue are needed for reserve.
  3. When 10% or more of a book is needed by a professor for more than one term.
  4. When an out-of- print book, which is not available for purchase, is needed for electronic reserve.
  5. Any copyright permission that the Copyright Clearance Center cannot provide will be the  faculty member’s responsibility to seek directly from the copyright holder, to include student papers.

The Library will assume that faculty members who submit photocopied items for reserve use have prepared copies within the terms of Fair Use.  However, if an item is to be used in more than one course at a time, or for the same course on a repeating basis (successive terms, annually, etc.), permission should be obtained from the copyright holders.  Copies of the permission letters or statements must be submitted to the library with the materials.
