Dear Colleagues,
We write to you with an update regarding the letters of appointment for faculty who have an adjunct appointment. A new state law, AB 736, has expanded the conditions under which adjunct faculty at private colleges and universities may be treated as salaried professionals. Briefly stated, all adjunct faculty, regardless of the number of courses taught, can be classified as exempt as long as they earn a minimum rate for each classroom hour of course-related work.
In practical terms, Santa Clara will begin to classify all adjunct faculty as exempt, and will be able to pay faculty by a flat rate for each course rather than at an hourly rate. Please note that the amount of the standard course rate will not be impacted. Below is our timeline for implementation:
Quarterly Adjunct Faculty beginning Summer 2021
Semester Adjunct Faculty Fall 2021 (August 1, 2021)
Academic Year Adjunct Faculty Fall 2021 (September 1, 2021)
